 |  This Acceptable Use Policy document, including the following list of Prohibited Activities, is a part of your Hosting Agreement with AllDedicated. If you engage in any of the activities prohibited by this AUP document AllDedicated may suspend or terminate your account without notice. If your account is terminated due to violations of this AUP your money will NOT be refunded.
AllDedicated's Acceptable Use Policy (the "Policy") for AllDedicated Services is designed to help protect AllDedicated, AllDedicated's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by AllDedicated. AllDedicated reserves the right to modify the Policy at any time, effective upon posting at TOS.
Prohibited Uses of AllDedicated's Systems and Services:
1. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
2. Sending Unsolicited Bulk Email ("UBE", "spam"). The sending of any form of Unsolicited Bulk Email through AllDedicated's servers is prohibited. Likewise, the sending of UBE from another service provider advertising a web site, email address or resource hosted on AllDedicated's servers, is prohibited. AllDedicated accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.
3. Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by AllDedicated customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any AllDedicated-hosted domain, or referencing any AllDedicated account, is prohibited.
4. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.
5. Operating an account on behalf of, or in connection with, or reselling any service to, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org.
6. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").
7. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
8. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any AllDedicated customers or end-users by any means or device.
9. Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the AllDedicated network or on another provider's network.
10. Using AllDedicated's Services to interfere with the use of the AllDedicated network by other customers or authorized users.
11. Each AllDedicated customer is responsible for the activities of its users (customers) and, by accepting service from AllDedicated, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of a AllDedicated customer will be forwarded to the AllDedicated customer's abuse department for action. If violations of the AllDedicated Acceptable Use Policy occur, AllDedicated reserves the right to terminate services with or take action to stop the offending customer from violating AllDedicated's AUP as AllDedicated deems appropriate, without notice.
12. Running IRC servers or offering shell account services.

|  | Violations of system or network security may result in civil or criminal liability. AllDedicated will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. These violations include, without limitation:
1. Accessing data not intended for such User or logging into a server or account, which such User is not authorized to access.
2. Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization.
3. Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing".
4. Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting.
5. Taking any action in order to obtain services to which such User is not entitled. |  |  Violation of AllDedicated's SPAM policy will result in severe penalties. Upon notification of an alleged violation of our SPAM policy, AllDedicated will initiate an immediate investigation (within 48 hours of notification). During the investigation, AllDedicated may restrict customer access to the network to prevent further violations. If a customer is found to be in violation of our SPAM policy, AllDedicated may, at its sole discretion, restrict, suspend or terminate customer's account. Further, AllDedicated reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. AllDedicated will notify law enforcement officials if the violation is believed to be a criminal offense.
First violations of this policy will result in an "Administrative Fee" of $250 and your account will be reviewed for possible immediate termination. A second violation will result in an "Administrative Fee" of $500 and immediate termination of your account. Users who violate this policy agree that in addition to these "Administrative" penalties, they will pay "Research Fees" not to exceed $175 per hour that AllDedicated personnel must spend to investigate the matter. PLEASE, DO NOT SPAM from your account!
IMPORTANT NOTICE:
BEGINNING IMMEDIATELY, anyone hosting websites or services on their server that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their server immediately removed from our network. The server will not be reconnected until such time that you agree to remove ANY and ALL traces of the offending material immediately upon reconnection and agree to allow us access to the server to confirm that all material has been COMPLETELY removed. Severe violations may result in immediate and permanent removal of the server from our network without notice to the customer. Any server guilty of a second violation WILL be immediately and permanently removed from our network without notice. |
